Requirements to Register a Charity or Fundraiser
Thousands of Illinoisans rely heavily on the work of charities and nonprofits, and there are few doubts that the breadth of nonprofits in Lake County is helping make the entire community better. For this reason, among others, Illinois Attorney General Lisa Madigan encourages Lake County citizens to practice charitable giving. Although nonprofit laws can be quite complex, James C. Provenza seeks to further the scope of charitable giving in Lake County. Although our office does handle the creation and management of Charitable Trusts, we’ll also help you navigate through the legal matters related to founding a charity or nonprofit.
Under Illinois law, fundraisers and charities must register every year with the Attorney General’s office. When filing for a charity in Lake County, you will need to send the $15 Filing Fee via check payable to the Illinois Charity Bureau Fund. Other forms include:
- Form CO-1, the “Charitable Organization Registration Statement.”
- If the organization has been in existence for more than a year, you also need to fill out Illinois Form AG990-IL.
- Also provide a copy of your Federal Returns for the last three years.
- If applicable, you need Form CO-3, the “Religious Organization Exemption Form.”
- If you’re filing for nonprofit status, you’ll need to draft a Illinois Articles of Incorporation, all Amendments to the Articles, and the Bylaws of the Incorporation.
Keep in mind that these are not the only documents you’ll need to fill out and send to the Attorney General’s office. Also, every year you’ll need to register again with annual reports.

Illinois Secretary of State Office
Nonprofit corporations in Lake County, as well as throughout Illinois, must file their Articles of Incorporation (Form NFP 102.10) with the Secretary of State’s Office. Please note that the Articles should state the purpose of a nonprofit in Lake County, and this purpose must be selected among the 33 purposes listed in the General Not For Profit Corporation Act, Section 103.05(a).

Lake County Probate Court
With any charitable organization, nonprofit corporation, or fundraising, if there is an estate or a charitable trust involved, you may need to attend probate court for the distribution of assets of someone who has died, will authentication in contested matters, estate supervision, and the enforcement of wills, among many other services.
Lake County is part of the 19th Judicial Circuit of Illinois, and as such, you’ll need to visit the Probate Division of the Park City Branch Court for any matters dealing with probate law. The Lake County Circuit Court in Park City is located at:
